1. Copyright & Intellectual Property

​

1.1 All images, video, artwork, text, design elements, and visual content on this website are the sole intellectual property of Shakey Finger Photography and are protected under New Zealand copyright law (Copyright Act 1994).

1.2 Purchasing or commissioning photography does not transfer copyright.
Shakey Finger Photography retains full ownership, authorship, and moral rights for every image created.

1.3 Images may not be copied, edited, altered, resold, distributed, or used for commercial purposes without an appropriate licence or written permission.

1.4 Any unauthorised use of imagery may result in legal action or invoicing for the appropriate commercial licence fee.

2. Image Licensing & Usage Rights

​

2.1 When you commission or purchase images, you are granted a usage licence, which outlines where and how the images may be used.

2.2 Licences are typically categorised into:

  • Personal Use (prints, gifts, home display)

  • Commercial Use (websites, advertising, branding)

  • Editorial Use (magazines, news, blogs)

  • Designer/Agency Use (creative projects for third parties)

2.3 Usage rights vary depending on the project and will be stated on your invoice, contract, or delivery agreement.

2.4 Images may not be used outside the agreed licence (e.g., in paid advertising, print campaigns, merchandise, resale, or third-party projects) without purchasing an extended licence.

2.5 Licence upgrades are available at any time.

3. Bookings, Payment & Cancellations

3.1 Bookings are confirmed once a deposit or written agreement is received.

3.2 Deposits are generally non-refundable, unless otherwise specified.

3.3 Full payment is required before final images are delivered.

3.4 Travel, accommodation, or special access fees (if required) will be agreed upon before the shoot.

3.5 If you need to reschedule, please provide reasonable notice. We will do our best to accommodate changes.

3.6 Cancellations within 48 hours of a booking may incur a fee to cover lost time and preparation.

4. Weather, Safety & Rescheduling

4.1 West Coast weather can be unpredictable. If conditions are unsafe or unsuitable, Shakey Finger Photography may reschedule the session at no charge.

4.2 Drone and aerial photography is subject to New Zealand Civil Aviation Authority (CAA) safety rules. Weather or flight restrictions may require adjustments.

4.3 We reserve the right to refuse a shoot if a location or environment poses safety risks.

5. Image Delivery & Editing

​

5.1 Final images are delivered in high-resolution and web-optimised formats.

5.2 Typical delivery timeframes:

  • Portraits & families: 1–2 weeks

  • Commercial projects: 2–4 weeks

  • Weddings & elopements: 4–8 weeks

5.3 RAW files are not provided, as they are part of our creative process and copyright protection.

5.4 Standard editing includes colour grading, exposure correction, and light retouching. Additional retouching can be arranged at an agreed fee.

6. Client Responsibilities

​

6.1 Clients are responsible for:

  • Obtaining permissions for private locations

  • Ensuring participants are aware they are being photographed

  • Providing accurate information before the shoot

6.2 Shakey Finger Photography is not responsible for delays caused by late arrivals, unprepared participants, or incomplete information.

7. Website Use & Content Accuracy

7.1 The information on this website is provided in good faith but may be updated or changed at any time.

7.2 Shakey Finger Photography is not liable for technical issues, website interruptions, or inaccuracies that occur due to third-party platforms.

8. Privacy & Personal Information

​

8.1 Your information is collected solely for communication, booking, and service delivery.

8.2 Your details will never be sold, shared, or disclosed to third parties except where required by law or for service delivery (e.g., printing labs).

8.3 You may request access to or deletion of your personal information at any time.

9. Limitation of Liability

​

9.1 While we take great care in all work, Shakey Finger Photography is not liable for:

  • Events outside our control (weather, access limitations, equipment failure, etc.)

  • Loss of income, profit, or data arising from use of images

  • Issues caused by client misuse of images or failure to follow licensing terms

9.2 Liability is capped at the total amount paid for the service or product in question.

10. Changes to These Terms

10.1 Shakey Finger Photography may update these Terms from time to time.
Continued use of the website or services indicates acceptance of any updated Terms.
